Terms of Service

These Terms of Service (“Terms”) govern your use of QEST, operated by Conglomerate Media Group, LLC (“QEST,” “we,” “us”), at qest.kids and through the QEST app for iOS (together, the “Service”). They apply to the website and the mobile app equally. By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use QEST.

Who can use QEST

You must be at least 18 years old and able to form a binding contract to create a QEST account. QEST accounts are for parents and legal guardians. A child uses the Service only through a profile that a parent or guardian creates and manages, or a self-login a parent explicitly enables via a claim code. By adding a child profile, you confirm you are that child's parent or legal guardian, or are otherwise authorized to manage their information, and you consent on their behalf to the collection and use of their information as described in our Privacy Policy.

Your account

You are responsible for keeping your account credentials secure and for all activity under your account, including any caregiver accounts you invite and any child accounts you enable. Notify us promptly at support@qest.kids if you suspect unauthorized access.

Subscriptions and billing

QEST offers a free plan and paid subscription plans with additional features and higher limits. Paid subscriptions are purchased on the QEST website and billed in advance on a recurring basis, renewing automatically until canceled. If you start a subscription from the iOS app, checkout opens in your browser and the subscription is handled by us and Stripe, not by Apple.

Stripe is the merchant of record for paid subscriptions. That means the Stripe entity for your region is the seller named on your receipt, charges your payment method in your local currency where supported, calculates and remits any applicable sales tax or VAT, and handles refunds and payment disputes under Stripe's own purchase terms, which you accept at checkout. QEST remains responsible for the Service itself.

You can cancel at any time from Settings. Cancellation takes effect at the end of your current billing period, and unused time is not refunded except where the law requires it. Where a plan includes a free trial period, it converts to a paid subscription at the end of the trial unless you cancel before it ends. We may change subscription pricing or plan features going forward, and will give you reasonable notice before any change takes effect for an existing subscription.

Founding Families

Families accepted into the Founding Families program receive the Family+ plan at no charge for as long as their family account exists and QEST operates, together with a founding mark shown wherever families meet in QEST. Founding status is granted at our discretion, belongs to the family that applied, cannot be transferred, sold, or exchanged for cash, and may be withdrawn from a family that violates these Terms.

Community and content standards

QEST includes optional features that let your family connect with other families: family profiles, a shared feed with posts and comments, tags and mentions, and direct messages. When you use them, you are interacting with real families and real children.

We have zero tolerance for objectionable content and for abusive users. You agree not to post, send, upload, or share anything that:

  • Sexualizes, exploits, or endangers a child in any way, or depicts a child inappropriately.
  • Is pornographic, sexually explicit, or obscene.
  • Harasses, bullies, threatens, intimidates, or targets another person, including any child.
  • Is hateful toward, or promotes violence or discrimination against, a person or group based on race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, age, or any other protected characteristic.
  • Depicts or encourages violence, self-harm, suicide, or eating disorders.
  • Promotes illegal activity, drugs, alcohol, tobacco, weapons, or gambling.
  • Is spam, a scam, a phishing attempt, or an attempt to sell or advertise to other families.
  • Impersonates another person or family, or misrepresents who you are.
  • Infringes someone else's copyright, trademark, privacy, or other rights, or shares another person's private information without their permission.
  • Is otherwise unlawful, or objectionable in a place families and children are present.

You also agree not to solicit personal contact information from another family's child, arrange contact with a child outside the app, or attempt to connect with children outside the parent-approved friendship flow.

We filter what we can at the source: GIF search inside QEST is restricted to G-rated results, and a message, post, or comment containing certain words is refused automatically when it is sent. Everything else people post is subject to the reporting and enforcement process below.

Reporting, blocking, and enforcement

Every post, comment, message, and family profile can be reported from inside the app using the report control on it, and a parent can block another family from that family's profile, which immediately ends messaging and hides them from your feed. Reports are not anonymous to us but the person reported is never told who reported them.

We review reports and act on them, ordinarily within 24 hours of receiving them. We may remove content, restrict a feature, suspend an account, or terminate an account and its family entirely, without notice, for a violation of these standards. Accounts that engage in the conduct listed above may be removed permanently and are not entitled to a refund. You can also reach us directly at support@qest.kids, and we will respond to reports of content that endangers a child as our highest priority.

Acceptable use

Beyond the content standards above, you agree not to:

  • Use QEST for any unlawful purpose or in a way that violates these Terms.
  • Attempt to access another family's data or another user's account.
  • Interfere with or disrupt the Service, including through automated scraping or attempts to bypass rate limits or access controls.
  • Reverse engineer or attempt to extract the source code of the Service, except as permitted by law.

Content you provide

You retain ownership of the information and content you add to QEST (family and child names, custom Qests and rewards, photos, notes, posts, and messages). You grant us a license to host, store, and display that content as needed to operate the Service for you: within your family, and, for anything you post or send to another family, to the people you shared it with. We do not use your family's content to train AI models, ours or anyone else's, and we do not share it with other QEST families beyond what you deliberately share.

You are responsible for what you upload, including confirming you have the right to share any photo or video of another person.

AI-generated features

QEST offers optional insight reports and setup suggestions generated by an AI model, as described in our Privacy Policy. These are generated automatically, may be incomplete or wrong, and are meant as a prompt for your own judgment. They are not professional parenting, psychological, educational, or medical advice, and you should not rely on them as such.

Third-party services

QEST integrates with third-party services you may choose to use, including Sign in with Google, Apple, and Microsoft, optional Google, Outlook, and Apple calendar sync, GIF search through GIPHY, and sharing to social platforms. Your use of those providers is also subject to their own terms and privacy policies. We are not responsible for the availability or practices of third-party services.

The iOS app

These Terms are between you and Conglomerate Media Group, LLC only, not with Apple, and we alone are responsible for the QEST app and its content. Your license to use the app on Apple devices is a non-transferable license to use it on any Apple-branded device you own or control, as permitted by the App Store Terms of Service.

Apple has no obligation to provide any maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund your purchase price for the app, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. We, not Apple, are responsible for addressing any claim relating to the app, including product liability claims, any claim that the app fails to conform to a legal requirement, and any claim arising under consumer protection or similar legislation, as well as any third-party claim that the app infringes intellectual property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Disclaimers

QEST is provided “as is” and “as available.” We work to keep the Service reliable and accurate, but we do not guarantee it will be uninterrupted, error-free, or fit for every purpose. QEST is a family organization and habit-building tool, not professional childcare, educational, medical, or parenting advice.

Limitation of liability

To the fullest extent permitted by law, QEST and Conglomerate Media Group, LLC will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us, if any, in the 12 months before the claim arose.

Termination

You can stop using QEST and delete your account at any time, from your profile in the web app or the iOS app. Access ends immediately and any paid subscription is canceled; the data is held for 30 days so an accidental deletion can be reversed, then destroyed permanently. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or to other users, particularly where a child's safety is involved, and will make reasonable efforts to notify you first except where immediate action is necessary.

Governing law

Conglomerate Media Group, LLC is organized in the State of Wyoming, United States. These Terms are governed by Wyoming law, without regard to its conflict-of-laws rules, and any dispute relating to them or to the Service will be brought in the state or federal courts located in Wyoming, which you and we agree to submit to. If the law of the country you live in gives you the right to bring a claim in your own local courts, or entitles you to the protection of your own country's consumer laws, nothing here takes that away.

Language

QEST is offered in English and Spanish. These Terms and our Privacy Policy are written in English. If we publish a translation and it ever differs from the English text, the English text governs.

Changes to these Terms

We may update these Terms as QEST evolves. If we make a material change, we will update the date at the top of this page and, where appropriate, notify you directly. Continued use of the Service after a change takes effect means you accept the updated Terms.
